Title IX Student Handbook

8/1/2024

Authors: Patricia Hamill, Lorie Dakessian, Jonathan Cohen, and Lindsay McDonald Dugan

On August 1, 2024, new Title IX policies and procedures went into effect at many colleges and universities across the country in order to comply with recently issued regulations by the U.S. Department of Education. This document explains some of the most important issues likely to face parties in Title IX cases proceeding under policies and procedures established to comply with the new regulations. It should go without saying that the stakes involved in prevailing in a Title IX matter are high. If you are a complainant, a finding by your college that the respondent (the accused person) is not responsible for misconduct could leave you feeling unvalidated and betrayed—and you may have to continue attending school with the respondent. If you are a respondent, losing your Title IX case could lead to sanctions as severe as expulsion. Even if you receive a relatively light sanction (for example, probation), a finding of responsibility may hurt your future academic or career prospects. Graduate schools, licensing boards, and some employers may require disclosure of college disciplinary sanctions. In sum, if you are a student complainant or a respondent in a Title IX matter, you need to understand how the Title IX process works.
